Is it a cake or a biscuit?

For years we've enjoyed the chocolatey, biscuity, cakey goodness of Chocolate Teacakes, but after nearly 20 years the European Court of Justice has ruled they are actually cakes after all.

As a cake the product does not attract VAT on it's sales, although as the Treasury Office had previously classed it as a biscuit over £3.5m worth of VAT has been charged to the consumer.

Some retailers have had the VAT they paid on these products returned, but M&S has complained that Revenue and Customs had handed supermarkets back the VAT wrongly paid by customers, while refusing to do the same for them.

I don't see why this £3.5m couldn't be written off all out taxes this year, as it's us that were wrongly charged, not the supermarkets. Hell, give it to a good cause, but just giving it to the retailers? No wonder M&S have got their knickers in a twist if they're not seeing any of it either.

All that remains now is for Jaffa Cakes to be reclassified as cakes and I'm due thousands of Pounds in over paid taxes. Curse their orangey goodness.
